It will be understood that when purchasing original art from this site you agree with the Terms of Sale. Please note that depth and range of colors of the images below are limited to the capability of the monitor that the image is being viewed on.  Most colors tend to appear less saturated on a monitor than the original artwork.) Please print and read these Terms of Sale and Shipping Policy as it contains important information about my service. Use of this site constitutes your acceptance of the Terms of Service. As the Internet and my site develops over time, these Terms of Service might change. I do encourage you to return again to see if there have been any changes to my privacy policy and/or Terms of Sale and Shipping Policy.

Terms of Sale for Original Art

1. 1.  Copyright of the Artwork remains the property of the Artist.
   

2. 2.  Artist shall have the right to photograph piece, if necessary, for publicity or reproduction purposes.
   

3. 3. Artist may contact you for permission to include the artwork in retrospective show for up to three months. Permission is at your discretion.  All shipping and handling costs will be paid by the Artist.
   

4. You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including

any internet website for any purpose.

5. If you breach any of your obligations under paragraph (4) you agree that:

1. a.the payment of damages will not be a sufficient remedy to compensate the Artist for your breach;
   

2. b.the Artist may apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and
   

3. c.the Artist may contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.
   

Shipping

Orders are usually shipped within 1 to 2 days of your order.  All artwork is shipped USPS Priority. All items shipped are insured during shipment. If the package appears damaged when you receive it, you should refuse to accept it. If damage is discovered after you have accepted delivery, please contact the artist as soon as possible.  If you have special shipping requirements, please contact the artist at the time of placing the order.

Returns

If there is a material misrepresentation** or error on original artwork sales, please contact me by email  within 3 days of receipt of the order. I will then instruct you on return shipping instructions. If the error is from me, I will either correct the order at no charge to the Customer or if I cannot fulfill the order for any reason, I will promptly issue a full refund including shipping charges, if applicable, upon receipt of the original order in its original condition.

All other returns after the 3 day notification period will be issued a credit towards another purchase upon return of the merchandise in its original condition.

**Material misrepresentation definitions that would lead to a full refund on a purchase of an artwork:

1. ✓ Artwork Size wrong by 10% or more.
   

2. ✓ Wrong image altogether.
